The Ministry of Road Transport and Highways (MoRTH)notified the Compensation to Victims of Hit and Run Motor Accidents (Amendment) Scheme, 2026. The amendment modifies several provisions of the existing Compensation to Victims of Hit and Run Motor Accidents Scheme, 2022, including administrative processes, definitions and institutional responsibilities. The revised scheme will come into force from the date of its publication in the Official Gazette.
Changes in Definitions and Terminology
The amendment updates certain definitions used in the scheme. New terms such as “Fund”, referring to the Motor Vehicle Accident Fund, and “portal”, referring to the electronic system developed by the General Insurance Council for scheme operations, have been added.
The notification also replaces some references to “General Insurance” with “GI Council”, aligning the terminology with the council constituted under the Insurance Act, 1938.
Role of District and State Road Safety Bodies
Under the amended framework, District Road Safety Committees will monitor implementation of the scheme at the district level. Their responsibilities include maintaining monthly records of compensation claims, reviewing pending cases, coordinating with district authorities, and assisting claimants.
Similarly, State Road Safety Councils or authorities designated by state governments will review implementation at the state level. Their role includes assessing progress, reviewing claim statistics, and issuing directions to district authorities where required.
Digital Processing of Compensation Claims
The scheme introduces a stronger digital process for handling claims. Applications for compensation can be submitted electronically to the Claims Enquiry Officer of the concerned subdivision or taluka where the accident occurred.
Once the enquiry report is received, the Claims Settlement Commissioner is expected to approve the claim within 15 days, wherever possible. The sanction order will be communicated to the General Insurance Council through the portal for payment from the Motor Vehicle Accident Fund.
Updated Application and Documentation Requirements
The notification replaces earlier application forms with revised formats. Claimants must provide details such as identity proof, accident information, bank account details, and supporting documents including FIR copies and medical or post-mortem reports.
The updated forms also include fields for electronic accident records and claimant contact information to support digital processing of claims.
